“Services” refers to the ability to stream content on third-party platforms via our internal browser.

“Users” refers to individuals who download and use Plasma.

Plasma allows users to stream content on various third-party platforms and provides a seamless way to access these platforms directly.

Streaming Services: Users can stream content effortlessly across different platforms. We are committed to continuously updating our offerings to enhance compatibility and user experience.

Safety and Security: We prioritize user safety and security. Our systems ensure a secure environment, and we strictly prohibit abusive behavior and misuse of our Services.

Improvement of Services: We analyze how our Services are used to constantly improve user experience.

You must use our Services only in accordance with these Terms. It is essential to read and follow the terms of any third-party platforms you choose to use.

If you are banned from any third-party platform, you will not be able to stream through Plasma to that platform. Therefore, it is your responsibility to read their policies carefully.

You agree to access and use our Services only for legal and authorized purposes. You will not use, or assist others in using, our Services in ways that:

• Violate the rights of AI THINKING MACHINES LTD or others.
• Are illegal, threatening, harassing, or misleading.
• Involve sending illegal communications such as spam or auto-messaging.
• Impersonate someone else or publish false information.
• Include non-personal use of our Services without authorization.

When you use our Services to access third-party platforms, their terms and policies will govern your use of those services.

Your Rights: Plasma does not claim ownership of the information and material you submit through our Services. If you do not own the rights to that information, please refrain from using our Services.

Intellectual Property Rights: We own all Intellectual Property Rights related to our Services. You may not use our Intellectual Property without our prior written consent.

Your License to Us: You grant Plasma a royalty-free, worldwide license to transmit any content you stream through our Services. This permission also extends to our subcontractors.

WE TAKE REASONABLE MEASURES AND METHODS TO PROVIDE OUR SERVICES TO YOU IN A SAFE, SECURE AND ERROR-FREE ENVIRONMENT, HOWEVER, WE CANNOT GUARANTEE THAT PLASMA APP WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS, ERRORS OR IMPERFECTIONS. PLASMA APP’S SERVICES MAY BE SUBJECT TO LIMITATIONS OR ISSUES INHERENT IN THE USE OF THE INTERNET AND PLASMA APP IS NOT RESPONSIBLE FOR ANY PROBLEMS OR OTHER DAMAGE RESULTING FROM SUCH LIMITATIONS OR ISSUES. YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SERVICES ARE PROVIDED TO YOU STRICTLY ON AN “AS IS” BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE AND PURPOSE, TITLE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES OR THE FEATURES, SERVICES AND INTERFACES OUR SERVICES PROVIDE. WE ARE NOT RESPONSIBLE FOR AND ARE NOT OBLIGATED TO CONTROL THE ACTIONS OR INFORMATION (INCLUDING CONTENT) OF OUR USERS OR OTHER THIRD PARTIES. YOU RELEASE US, OUR SUBSIDIARIES, AFFILIATES, AND OUR AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AND AGENTS (TOGETHER, THE "PLASMA APP PARTIES") FROM ANY CLAIM, COMPLAINT, CAUSE OF ACTION, OR CONTROVERSY (TOGETHER, "CLAIM") AND DAMAGES, KNOWN AND UNKNOWN, RELATING TO, ARISING OUT OF, OR IN ANY WAY CONNECTED WITH ANY SUCH CLAIM YOU HAVE AGAINST ANY THIRD PARTIES. YOU ARE RESPONSIBLE FOR USING THE SERVICES IN ACCORDANCE WITH THE TERMS SET FORTH HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES AND SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOUR RIGHTS WITH RESPECT TO PLASMA APP ARE NOT MODIFIED BY THE FOREGOING DISCLAIMER IF THE LAWS OF YOUR COUNTRY OF RESIDENCE, APPLICABLE AS A RESULT OF YOUR USE OF OUR SERVICES, DO NOT PERMIT IT.

PLASMA’S AGGREGATE LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES IS LIMITED TO THE TYPICALLY OCCURRING FORESEEABLE DAMAGES (EXCEPT IN RELATION TO DEATH, PERSONAL INJURY, FRAUDULENT MISREPRESENTATION OR WILLFUL MISCONDUCT) AND IN NO EVENT SHALL PLASMA APP PARTIES’ LIABILITY RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES EXCEED IN THE AGGREGATE THE TOTAL AMOUNT PAID BY YOU TO PLASMA APP UNDER THESE TERMS DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE ACT OR OMISSION GIVING RISE TO THE LIABILITY. ANY ADDITIONAL LIABILITY OF PLASMA APP PARTIES IS EXCLUDED.

IN NO EVENT SHALL PLASMA APP PARTIES BE LIABLE FOR (I) ANY INDIRECT, SPECIAL, COVER, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF USE, DATA, BUSINESS, PROFITS OR REVENUES (IN EACH CASE WHETHER DIRECT OR INDIRECT) REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT (INCLUDING NEGLIGENCE OR OTHERWISE), ARISING UNDER THESE TERMS, US, OR OUR SERVICES AND WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, EVEN IF THE PARTY KNEW OR SHOULD HAVE KNOWN THAT SUCH DAMAGES WERE POSSIBLE AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW. YOUR RIGHTS WITH RESPECT TO PLASMA APP ARE NOT MODIFIED BY THE FOREGOING LIMITATION IF THE LAWS OF YOUR COUNTRY OF RESIDENCE, APPLICABLE AS A RESULT OF YOUR USE OF OUR SERVICES, DO NOT PERMIT IT.

To the maximum extent permitted by applicable law, you agree to release, defend (at PLASMA’S option), indemnify, and hold PLASMA Parties, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• your breach of these Terms or our Policies,
• your access to or use of the App or any of our Services, including information provided in connection therewith,
• your interaction with any user, business, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction,
• your breach of any applicable laws, regulations or third party rights, or
• any misrepresentation made by you.

The indemnification obligation according to this paragraph only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your culpable breach of a contractual obligation.

We may add or remove Services or features at any time. Maintenance or technical issues may cause interruptions in our Services.

These Terms are effective until you or Plasma terminate the relationship. You may terminate your relationship with Plasma by deleting the App.

These Terms are governed by the laws of Cyprus.

PLASMA reserves the right to update, revise, amend and/or modify these Terms at any time in accordance with this provision. If we make changes to these Terms, we will post the revised Terms on the Website and App and update the “Last Modified” date at the top of these Terms. Continued use of the app after changes constitutes acceptance of the revised Terms.

Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. We reserve the right to limit our Services in any country.

No joint venture, partnership, employment, or agency relationship exists between you and PLASMA as a result of these Terms or your access and/or use of the Services.

These Terms do not and are not intended to confer any rights or remedies upon any person other than the parties.

If any provision of these Terms is held to be unlawful, void, invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions of our Terms, and the remaining portion of our Terms will remain in full force and effect.

PLASMA’S failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

You may not assign, transfer or delegate these Terms and your rights and obligations hereunder.
